Terms of Service

Last updated: [DATE]
Template — not yet legal advice. This is a working draft describing how XAUUSD Desk actually operates, written to give a solicitor a real starting point. It has not been reviewed by a qualified lawyer. Do not rely on it, and do not present it to customers, until it has been reviewed and completed for your jurisdiction. Bracketed [PLACEHOLDERS] must be filled in.

1. Who we are

XAUUSD Desk (“we”, “us”, “the Service”) is operated by [COMPANY LEGAL NAME], [COMPANY TYPE / REGISTRATION NUMBER], registered at [REGISTERED ADDRESS]. You can contact us at [CONTACT EMAIL]. These Terms govern your use of the website at wenlambo-desk.pages.dev and any associated features.

2. What the Service is — and what it is not

XAUUSD Desk provides market data and analytics for informational purposes only. It aggregates publicly reported news and economic-calendar data, classifies it for potential relevance to the gold (XAU/USD) market, and computes a heuristic “day-bias” score from price action, economic releases, and news sentiment.

Nothing on the Service is investment advice, a personal recommendation, a solicitation, or an offer to buy or sell any financial instrument. We are not a financial adviser, broker, or portfolio manager, and we do not take into account your personal circumstances, objectives, or financial situation. Directional language (for example “bullish”, “bearish”, or “sell rallies”) describes our automated reading of aggregated data — it is not a recommendation that you take any action. [FCA NOTE: confirm with a solicitor whether any authorisation or wording change is required before charging UK customers.]

3. Risk disclaimer

Trading leveraged products such as spot gold, CFDs, and futures carries a high level of risk and can result in the loss of some or all of your capital. Past performance and any signal, score, or classification shown on the Service are not indicative of future results. You are solely responsible for any trading or investment decisions you make. If you are unsure, seek advice from an independent, appropriately authorised financial adviser.

4. Data accuracy

Market data, news, and economic figures are obtained from third-party sources and automated processes. They may be delayed, incomplete, or inaccurate. The Free tier is explicitly delayed. We provide the Service “as is” and “as available” and make no warranty that any data is accurate, timely, or fit for any particular purpose. Do not rely on the Service as your sole source of information for any decision.

5. Accounts

You must provide a valid email address and keep your login credentials secure. You are responsible for activity under your account. You must be at least [18] years old and legally able to enter into these Terms. We may suspend or terminate accounts that breach these Terms.

6. Subscriptions, billing, and cancellation

  • The Free tier is provided at no cost. The Pro tier is a recurring subscription billed at [£19] per month.
  • Payments are processed by Stripe. We do not store your full card details.
  • Your subscription renews automatically each billing period until cancelled.
  • You may cancel at any time through the billing portal linked on your Account page. On cancellation your access reverts to the Free tier at the end of the current paid period.
  • [REFUND POLICY — state clearly, e.g. no refunds for partial periods, or a 14-day cooling-off period as may be required under UK/EU consumer law. Confirm with a solicitor.]
  • We may change subscription pricing on reasonable notice; changes will not affect the period you have already paid for.

7. Acceptable use

You agree not to:

  • resell, redistribute, scrape, or republish data from the Service without our written permission;
  • share your account or attempt to bypass plan gating or access controls;
  • interfere with, overload, or attempt to disrupt the Service or its infrastructure;
  • use the Service for any unlawful purpose.

8. Third-party services and links

The Service relies on and links to third parties (including Supabase, Cloudflare, Stripe, Resend, Telegram, TradingView, and various data sources). We are not responsible for the content, availability, or practices of those third parties. Your use of Telegram alerts is also subject to Telegram’s own terms.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for any trading losses, lost profits, or indirect, incidental, or consequential damages arising from your use of, or reliance on, the Service. Nothing in these Terms excludes liability that cannot be excluded by law (for example, for fraud or death or personal injury caused by negligence). [Confirm liability wording with a solicitor for your jurisdiction.]

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email or on the Service. Continued use after changes take effect constitutes acceptance.

11. Governing law

These Terms are governed by the laws of [England and Wales], and disputes are subject to the exclusive jurisdiction of its courts. [Confirm with a solicitor.]
